ACA Federal and State Filing/Furnishing Deadlines for the 2022 Tax Year

Here are the upcoming ACA reporting deadlines for the 2022 tax year. Federal ACA filing/furnishing deadlines may differ from state mandates, and it’s important to review your state’s filing/furnishing requirements.
ACA Federal Filing/Furnishing Deadlines

The IRS recently confirmed the end of good-faith transition relief, and it announced a permanent 30-day extension for furnishing 1095-B/Cs to employees. Note that the extension applies to furnishing, not filing.
· Forms 1095-C and 1095-B need to be furnished to full-time employees for the 2022 tax year by March 2nd 2023. The standard due date of January 31st has been automatically extended to March 2nd. During leap year the deadline is March 1st.
· Paper filing is allowed for employers filing fewer than 250 returns, and the deadline is February 28, 2023.
· Electronic filing is due by March 31st, 2023. One benefit of electronic filing is the later due date, and the IRS provides a confirmation of submission, including rejection or acceptance.
· If a deadline occurs on a weekend or a legal holiday, it is extended to the next business day.
· The IRS has proposed that the electronic filing requirements be reduced to 10+ returns, however this has not been finalized.

State ACA Filing/Furnishing Deadlines
Some states have statewide filing/furnishing requirements in addition to the federal filing/furnishing requirements. It is important to check if your state has its own filing requirements and verify the deadlines. Here are the state deadlines according to acawise.com:
California
In California furnishing 1095-B/Cs to employees is due January 31, 2023, and no extensions are available. ALEs must provide 1094 and 1095-B/C information to the California Franchise Tax Board by March 31, 2023, if their insurance providers do not report it.
Massachusetts
In Massachusetts, most insurance carriers will submit forms MA 1099-HC on behalf of ALEs to report minimum essential coverage to the state and furnish to employees. If not, employers are responsible for doing so. All self-insured ALEs must submit Form MA 1099-HC to the state and furnish copies to their employees.
The deadline to distribute copies of MA 1099-HC to employees is January 31, 2023. The deadline to submit MA 1099-HC forms to the state is also January 31, 2023. Forms must be filed electronically.
ALEs are also required to file the Health Insurance Responsibility Disclosure (HIRD) form with the state Department of Labor.
New Jersey
In New Jersey furnishing 1095-B/Cs to employes who are residents, including health coverage information, is due by March 2, 2023. This includes residents living in New Jersey 15+ days in any month. ALEs are required to file 1094 and 1095-B/C information with the New Jersey Division of Taxation by March 31, 2023.
Employers offering fully insured plans must furnish forms to employees and file electronically if their insurance carrier does not. ALEs with self-insured plans are responsible for furnishing forms to employees and filing electronically.
Rhode Island
In Rhode Island, the deadline for furnishing 1095-B/Cs to employees in Rhode Island is March 2, 2023. ALEs must file with the Rhode Island Division of Taxation. The deadline for filing 1094 and 1095-B/Cs with the state is March 31, 2023.
Washington D.C.
In Washington D.C., the deadline for furnishing 1095-B/Cs to employees that are state residents is March 2, 2023. ALEs that provide Minimum Essential Coverage to an employee must file with the Office of Tax and Revenue. Filing data must include the employee’s coverage type. The deadline for filing 1094 and 1095-B/Cs with the D.C. Office of Tax and Revenue electronically through MyTax.DC.gov is 30 days after filing the IRS (the final deadline is April 30, 2023).
